That means the new legislation cannot come into effect until after the elections. The German parliament meets for a two-week summer break starting on Wednesday.

If SPD and Greens agree, the court has also ordered another reading of the law. This would change the outcome of the vote to 18-4, making the new law inadmissible.

The opposition’s opposition

The law is set to extend copyright terms, significantly increasing the maximum life of a copyright from 50 to 95 years after the author’s death.

The opposition has come out strongly against the new law. “It will lead to a major imbalance between rights holders and users,” said the Greens’ Axel Vogt, arguing that those who profit most from the new law are not the authors and composers but the music and movie industries.

Critics have also said that the law opens the door to online platforms being responsible for the content that their users upload.

This may lead to them being forced to pay for the use of audio and video content, for example if video clips are used to promote a product or service.

The opposition has argued that the new law will lead to an explosion of copyright violations, leading to people uploading pirated material onto the internet.

“Copyright infringement is currently governed by the law, but the current legal situation is not very satisfactory,” said Joerg Haider, leader of the far-right Alternative for Germany (AfD) party.

The AfD has repeatedly called for a stricter approach to copyright.

Lawmaker of the AfD party, Jörg Meuthen, argued that the government is planning to turn Germany into a surveillance state.

“We need a regulation of the internet that requires uploaders to take into account the rights of the creative industries,” said Meuthen.
